Legal Opinion of Anthony J. Fejfar, B.A., J.D., Phd., Esq., Coif, Member, United States Supreme Court Bar, Imprimautur by Coif+++++++++++++++++++++++++++++++++++++++++++ The United States Military, including the Army, the Navy, the United States Armny Air Corps, the Air Force, and the Marine Corps, are all State Actors, Acting under Color of State Law for purposes of 42 United States Code section 1983, and, 18 United States section 242, and thus any Officer is civilly liable and criminally liable for violating the Substantive and Procedural Due Process Rights of any American civilian and any American Service Man, regardless of Rank, for issuing unreasonable orders which are not rationally related to a legitimate American Interest. Thus, any United States Service Man or Woman, regardless of rank, has the natural right and Consitutional right, without punishment, to reject a patently unreasonable order by a military superior, and to sue civilaly in Federal Court in such Superior Officer for issuing unreasonable orders.
